NZS 3910 §14 and §13 Quote-Check for an Architect in the CA role — Parnell heritage residences

Parnell heritage residences sit at $2-4M with steep north-facing sites and a long client relationship behind every design. The architect-CA's §14 determinations need to read fairly to both sides — the pre-award read is where that starts.

Parnell heritage residences are where the architect-CA's two roles pull hardest in opposite directions. A long design relationship sits behind the build; a $3M budget with little contingency sits in front of every §14 variation. The pre-award read keeps the determinations clean and the client conversation honest.

What you'll learn in this post

  • The §14 and §13 clauses the architect-CA owns in Parnell

  • Three Parnell-specific patterns that produce most §14 determinations

  • A 5-line desk check before you recommend acceptance

Quick answer: A NZIA architect in the CA role under NZS 3910:2023 reads a Parnell heritage-residence tender against §14 (variations) and §13 (dispute resolution), the §6.1.1 impartiality requirement, and NZIA Practice Notes on the dual role. Three Parnell patterns dominate: steep-site temporary works, heritage facade scope, and premium-joinery PC sums. A 30-minute desk check pre-award keeps determinations defensible and the principal relationship intact.

Parnell's high-end residential and embassy work — $2-4M residences, heritage-listed properties, steep north-facing sites with harbour views — is where the architect-in-CA arrangement carries the heaviest impartiality load. The architect's design relationship with the principal often runs back five or ten years across multiple projects. The §14 determinations land on a budget with very little contingency and a principal who is paying close attention to every variation.

The NZIA Practice Notes on the dual role are explicit. The §14 determination has to read fairly to both sides.

What §14 and §13 load onto the Parnell architect-CA

NZS 3910:2023 names the Engineer to the Contract; the two clauses that surface most often on Parnell heritage work:

  • §14 variations — particularly §14.2.1.1.d "changed conditions" on heritage cut-ins, and §14.6 PC sum administration on premium joinery and finishes.

  • §13 dispute resolution — the architect-CA's §14 determination is the file evidence at §13.

The §6.1.1 impartiality clause sits at the centre of every Parnell architect-CA arrangement. The architect's design knowledge is an asset for clean determinations and a liability if the determinations start reading as principal-favouring. NZIA Practice Notes on the dual role address this directly.

Three Parnell patterns that produce most §14 determinations

1. Steep-site temporary works and access. Most Parnell residential sites slope 1:4 to 1:3 toward the harbour. The earthworks contractor prices excavation; crane positioning, scaffold over the neighbouring boundary, and material lift methodology for heavy structural steel into a slope-locked envelope sit in §10.2 temporary works. The architect-CA's §14 determination needs to read against whether the tender documents specified the methodology or left it open. PI exposure on a $3M Parnell job is real.

2. Heritage-facade cut-in and substrate scope. Heritage-listed Parnell residences typically retain identified facade elements — pressed-metal ceiling soffit, decorative bargeboards, sash-window joinery, sometimes corner-board profile. The carpentry and painting quotes routinely price visible reinstatement and exclude substrate condition. When the substrate is opened up and found rotted, §14.2.1.1.d triggers and the architect-CA writes the determination. The architect's design knowledge of the existing fabric sharpens the reasoning.

3. Premium-joinery and bespoke-finish PC sums. Most $2-4M Parnell residences run premium aluminium joinery, stone and bespoke joinery, and high-end finishes on PC sums in the tender — full specification by selection during construction. §14.6 governs administration. Under-priced PCs are typical on bespoke runs; $20-80k §14.6 variations are common. The architect-CA's determination needs comparative quotes on file and a reasoned basis-of-selection memo.

The architect-CA-specific extras

Two extras worth pricing into the Parnell architect-CA review. First, heritage-overlay consents often require a heritage architect sign-off at key milestones — frequently a different architect from the design architect, which interacts with the architect-CA's role and the §14 determination chain. Second, embassy properties and high-end residences carry confidentiality and security requirements that constrain photography, drone surveys, and site documentation; the architect-CA's PS3/PS4 chain memo at appointment should name how site evidence will be captured for §14 files.

FAQ — Architect-CA quote-check for Parnell heritage residential

Q1: Can the architect-CA also sign off as the heritage architect on a heritage-listed Parnell residence? The roles can be combined, but the consenting authority may require an independent heritage architect for the heritage-specific sign-offs. The architect-CA's appointment letter should name the heritage architect arrangement explicitly.

Q2: What's the typical cost of a §14.6 PC sum variation on a Parnell premium-joinery scope? $20-80k on a $2-4M residence. The variation is the difference between the tender PC sum and the actual supplier quote at selection. The architect-CA's file evidence (comparative quotes, basis of selection, principal's acceptance) is the §14.6 administration record.

Q3: How do NZIA Practice Notes apply when the architect-CA's determination goes against the principal? The Practice Notes are explicit — the determination is the architect-CA's reasoned decision, not advocacy for either side. The principal's recourse if they disagree is §13 dispute resolution.

Q4: Does NZS 3910:2023 §14.5 give the contractor an automatic EoT on every §14 instruction? No — §14.5 requires the contractor to claim the time effect with the variation request, and the CA determines whether the time effect is justified. Reasoning sits in the file.

Q5: What's the most common scope ambiguity on a Parnell heritage residence? The interface between heritage-retained fabric and new structural insertions — particularly where the substrate behind retained finishes is unknown at tender. The contractor priced visible work; the substrate work surfaces at month 3-4.
