What the NZIA architect-CA owns in a C5 environment
NZS 3910:2023 and the NZIA Practice Notes on CA role apply unchanged on Waiheke. The contractual obligations:
Issue instructions under §6 and §9 in writing
Determine variations under §14 — the C5/C3 substrate dispute is the most common variation type
Certify progress payments under §12 against barged-deliveries milestones
Determine EOT under §10.3 — barge cancellations, sea-state delays, and ferry-strike days all qualify
Act impartially between principal and contractor (§6.1.1)
The §6.1.1 impartiality clause meets a Waiheke-specific test: the principal expects "Waiheke build, Waiheke cost" but the C5 atmosphere requires C5-grade materials that the principal often hasn't priced in. 1. The metal-cladding and roof-sheet fastener grade. AS/NZS 2312.1 places Waiheke coastal sites in C5 (very-high marine). MRM CoP and AS/NZS 3566 require Class 5 (austenitic stainless) fasteners in C5, not the Class 4 (galvanised) standard for C3. The roofer prices "all fixings to manufacturer's spec" off a generic detail; the trapezoidal metal sheet is correct but the fasteners are Class 4. At month 6 the early-warning rust telegraphs through the head; the §14 claim is $8-20k just to re-fix. The architect-CA who didn't call up "AS/NZS 3566 Class 5" in the head contract docs has no defence.
2. Joinery hardware and aluminium-suite corrosion warranties. Premium aluminium joinery on Waiheke needs a marine-grade powder coat and Class 5 hardware. Joinery suppliers price the standard residential suite (typical C3-rated finish) unless the spec calls up the marine grade explicitly. The 10-year powder-coat warranty voids in C5 environment with C3 product. $15-40k §14 claim when the supplier confirms the warranty position at handover.
3. Barge-ramp to site materials-handling. A Waiheke quote that reads "all materials to site" is silent on who handles the barge-ramp unloading, who arranges the truck-and-crane from Kennedy Point to the site, and who absorbs the demurrage if a barge slot is cancelled. AS/NZS 3500 (drainage), NZS 3604 (structural timber), and the metal sheet supply chain all turn into §14 claims when the materials-handling chain isn't documented.
